6th Annual Centanni-Cottle Memorial 5K Run and Walk

On March 24, 2010, Marines Sgt. Major Robert "RJ" Cottle and LCpl Rick Centanni were killed by an IED in Helmand Province, Afghanistan. Rick and RJ were there fighting to ensure our liberty and pursuit of happiness.

Please join us in the 6th Annual Memorial 5K Run/Walk to honor the service and sacrifice of Rick and RJ! All proceeds from this charity run will benefit the Rick Centanni Memorial Fund, the Kaila Cottle Trust in memory of her father SgtMaj Robert J. Cottle, Semper Fi Fund, Wounded Warrior Project, the American Legion and the Fisher House.

Each year the "Rick Centanni Memorial Fund”  awards scholarships to Esperanza High School student-athletes who are going into the military and plan on secondary education to assist them with books, tuition, etc. The Kaila Cottle Trust Fund will assist RJ's young daughter Kaila Cottle with tuition when she goes to college.

T-shirts, memorial wristbands and other items to the first 800 participants let the world know they were part of this special run. Entry fee is non refundable.

Event Rules & Guidelines

EVENT RULES & GUIDELINES APPLICABLE TO ALL PARTICIPANTS
The following event rules and guidelines are intended to help produce an event, to ensure the safety of all participants, to meet the requirements of local government permits. The Rick Centanni Memorial Fund retains the right to refuse entry to anyone declaring false information on their application, not making the required payment, or otherwise failing to meet the entry requirements. In any and all circumstances The Rick Centanni Memorial Fund retains the right to refuse entry to any person.

TERMS AND CONDITIONS OF ENTRY


PARTICIPATION

To register for the Centanni-Cottle Memorial 5k Run and Walk you must be 16 years of age or older on event day. Entrants aged 0 to 15 must be entered by a parent/guardian and must be accompanied at the event by a parent/guardian.

Each participant must agree to the disclaimer and these terms and conditions before participating in the event. All participants take part at their own risk and a disclaimer waiving all claims against The Rick Centanni Memorial Fund and any party acting on its behalf must be completed by all entrants. Registrants must be capable of completing the full distance, start line to finish line.

By taking part, all participants confirm that they are happy for their names and any footage or photographs taken during their participation in the Centanni-Cottle Memorial 5k to be used to publicise any Rick Centanni Memorial Fund event. Participant run number bibs are specific personal identifiers and cannot be exchanged with or sold to any other person. Transfers between runners can only be done through the official website within the deadline of transfer displayed on the website.

All entry fees are non-refundable, and can not be deferred towards a future event. Entries are non-transferable. Registration closure is determined and announced when event participation reaches the established capacity or a pre-set date.

EVENT DAY
Participants must follow instructions as given from all event officials including race staff, volunteers, medical personnel, security officers and city officials throughout the duration of the event.

All participants are expected to conduct themselves in a professional and courteous manner during their participation in the event. This means, for example, that urinating or defecating anywhere on or near the course shall be strictly prohibited except in toilet facilities. Anyone violating this rule of conduct shall be disqualified from the event and will be asked to leave the course.

Every participant shall be provided with an event bib number, which shall be conspicuously worn on the front (and back when applicable) during the event. The event bib number is to be worn as issued. No participant shall be permitted to participate in the event without the appropriate bib number.

All participants must write their name and details of any health problems or medication on the reverse of the run number, which must be worn on the front of their shirt during the run.

Baby joggers, baby strollers and wheelchairs, where the course route safely allows, are permitted on the course. Participants must begin the event during the official recognized starting times and in the interest of safety should start from the back of the group.

All participants must acknowledge and agree that personal information (including medical information entered on their run number or collected by event medical staff during or after the Event) can be stored, used and disclosed by the Rick Centanni Memorial Fund in connection with the organisation, promotion and administration of the Event and for the compilation of statistical information.


THE START
Participants shall assemble for the Big Warm Up, 20 minutes prior to the run starting. Participants shall then proceed to the start line. All participants must be positioned behind the starting line when starting.


COURSE MONITORING
Any participant who refuses to obey the directions of the event official, city official or course marshal, or who conducts himself/herself in an unsportsmanlike manner, or who is offensive by action or language to officials, volunteers, participants or spectators may be disqualified by the event and future participation at the discretion of race officials.


Any person who participates in the event without a current official event bib number not officially assigned to him/her is subject to removal and disqualification from future Rick Centanni Memorial Fund events.

No persons are authorized to be on the course unless they are registered participants - runners aged eight and under get free entry but must be registered, there is a free entry category on the event entry system for this purpose. A person will be allowed to accompany a participant if the participant is not physically/mentally able complete the course alone.


PARTICIPANT SAFETY
Participants are responsible for their recognition and understanding of event signage, symbols and colour relating to participant maps, facilities and direction.

Medical personnel authorized by the event to do so may examine any participant who appears in distress. If in the sole opinion of authorized medical personnel it is in the best interest of the participant's health and welfare, medical personnel can remove the participant from the event. Participants must retire at once from the run if ordered to do so by a member of the event’s official staff, official medical staff, or any governmental authority, including fire and police officers. Participants are responsible and assume liability for any and all medical expenses incurred as a result of training for and/or participation in the event, including but not limited to ambulance transport, hospital stays, physician and pharmaceutical goods and services.

Event officials reserve the right to delay, cancel, alter the route or suspend the event due to inclement weather in accordance with Emergency Protocol on severe emergencies and/or inclement weather. No refund will be issued in these circumstances.


PRIVACY POLICY
All customers agree to our privacy policy when they enter an event.

EXCEPTION
Any individual requesting a waiver of any of these rules from the event shall submit a written request no less than 30 days prior to the event date specifying the nature of and reasons for the request.


AMENDMENTS / RESERVATIONS / ACKNOWLEDGEMENTS
Event officials reserve the right, to modify, supplement or waive all or part of the event rules. Participants shall be bound by any modification or supplement of the event rules published prior to the event. Failure to follow these event rules, as can be amended, will result in immediate disqualification, loss of prize money and removal from official results.

Cancellation Policy
No cancellation or refunds will be issued once registration is complete.

Disclaimer

In order to run in the Centanni-Cottle Memorial 5k Run and Walk, runners must agree the following disclaimer:

WARNING: READ CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND DEPRIVES YOU OF THE RIGHT TO SUE THE RICK CENTANNI MEMORIAL FUND AND THE BLUE RIBBON TRUST FUND FOR ROBERT COTTLE , bda “THE RICK CENTANNI MEMORIAL FUND AND THE BLUE RIBBON TRUST FUND FOR ROBERT COTTLE” AND OTHER PARTIES. DO NOT ENTER INTO THIS AGREEMENT UNLESS YOU HAVE READ IT IN ITS ENTIRETY. SEEK THE ADVICE OF LEGAL COUNSEL IF YOU ARE UNSURE OF ITS EFFECT


"In completing this entry I declare that I, or anyone that I am paying for, will not compete in the run unless medically fit to do so and that, in any event, we will compete at my/our own risk. I accept that the organisers will not be liable for any loss, damage, action, claim, costs or expenses which may arise in consequence of my/our participation of the event.

I/We understand that entry fees are non-refundable.

I also hereby give my permission to pass my/our details to my chosen charity and to use my/our name, quotes, video footage, and photographic likeness for marketing and promotional purposes. I also agree to the full Terms and Conditions as displayed on the event website.

All activities conducted on Placentia-Yorba Linda Unified School District (hereafter referred to as District) property by Applicant shall be at the risk of the Applicant exclusively. Applicant shall indemnify and hold District, the Rick Centanni Memorial Fund, the Blue Ribbon Trust Fund for Robert Cottle, its officers, officials, agents, employees and volunteers harmless against any and all losses, damages, liability, claims, demands and causes of action arising out of or in any way connected with the use by the Applicant of District property, including premises liability. Applicant shall owe this indemnity obligation to the District, its officers, agents and employees even if loss, damage, liability, claim, demand or cause of action resulted from District’s alleged or actual negligent act or omission, regardless of whether such act or omission is active or passive. However, Applicant shall not obligate under this agreement to indemnify District respect to willful misconduct of District, its officers, agents or employees. District assumes no responsibility whatsoever for any property placed on the premises. Applicant further agrees to waive all rights of subrogation against the District."

If registering for an event electronically, you acknowledge and agree to the terms of this Waiver. Those under 18 must have a legal guardian read and initial waivers listed below.


WAIVER AND RELEASE OF LIABILITY

ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

IN CONSIDERATION of THE RICK CENTANNI MEMORIAL FUND AND THE BLUE RIBBON TRUST FUND FOR ROBERT COTTLE, allowing me to participate in the Centanni-Cottle Memorial 5k Run and Walk, I, for myself, and on behalf of my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors, assigns, agents, and representatives, hereby fully release THE RICK CENTANNI MEMORIAL FUND AND THE BLUE RIBBON TRUST FUND FOR ROBERT COTTLE, its officers, agents, representatives, employees, subsidiaries, and contractors (collectively, “Released Parties”) from any and all liabilities, claims, causes of action, or suits arising from or connected to my participation in any events for which I registered organized and sponsored by THE RICK CENTANNI MEMORIAL FUND AND THE BLUE RIBBON TRUST FUND FOR ROBERT COTTLE.
THE EVENTS MAY INVOLVE INHERENTLY DANGEROUS ACTIVITIES. I understand that participation involves risks and dangers which include, without limitation, the potential for serious bodily injury, permanent disability, paralysis and death; loss or damage to property; exposure to extreme conditions and circumstances; accidents, illness, contact or collision with other participants, spectators, vehicles or other natural or manmade objects; dangers arising from adverse weather conditions; imperfect course conditions; water, road and surface hazards; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the Event Organizers; and other undefined harm or damage which may not be readily foreseeable, and other presently unknown risks and dangers (“Risks”). I understand that these Risks may be caused in whole or in part by my own actions or inactions, the actions or inactions of others participating in the Event, or the acts, inaction or negligence of the Released Parties, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my participation in the Event.
I hereby Release, Waive and Covenant Not to Sue, and further agree to Indemnify, Defend and Hold Harmless the Released Parties with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss or expense (including court costs and reasonable attorneys fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate to my participation in the Event including without limitation claims for Liability caused in whole or in part by the negligence of the Released Parties. I further agree that if, despite this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liability which any may be incurred as the result of such claim, including all reasonable attorneys’ fees incurred in connection therewith. I hereby warrant that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by entering into it (including the rights of the minor, my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns), acknowledge that I have signed this Agreement freely and voluntarily, without any inducement, assurance or guarantee, and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. By using THE RICK CENTANNI MEMORIAL FUND AND THE BLUE RIBBON TRUST FUND FOR ROBERT COTTLE’s registration system, you agree to be bound by the terms herein.

IN CONSIDERATION of THE RICK CENTANNI MEMORIAL FUND AND THE BLUE RIBBON TRUST FUND FOR ROBERT COTTLE allowing me to participate in the Centanni-Cottle Memorial 5k Run and Walk, I, for myself, and on behalf of my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make the following contractual representations pursuant to this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement the “Agreement”;
1. I hereby represent that (i) I am in good health and in proper physical condition to participate in the Event; and (ii) I am not and will not be under the influence of alcohol or any illicit or prescription drugs which would in any way impair my ability to safely participate in the Event. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate in the Event.
2. I understand and acknowledge the physical and mental rigors associated with foot racing, and realize that running and other portions of such Events are inherently dangerous and represent an extreme test of a person’s physical and mental limits. I understand that participation involves risks and dangers which include, without limitation, the potential for serious bodily injury, permanent disability, paralysis and death; loss or damage to property; exposure to extreme conditions and circumstances; accidents, illness, contact or collision with other participants, spectators, vehicles or other natural or manmade objects; dangers arising from adverse weather conditions; imperfect course conditions; water, road and surface hazards; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the Event Organizers; and other undefined harm or damage which may not be readily foreseeable, and other presently unknown risks and dangers (“Risks”). I understand that these Risks may be caused in whole or in part by my own actions or inactions, the actions or inactions of others participating in the Event, or the acts, inaction or negligence of the Released Parties defined below, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my participation in the Event.
3. I agree to be familiar with and abide by the Rules and Regulations established for the Event, including but not limited to the Competitive Rules adopted by USA TRACK AND FIELD and the Guide to Prohibited Substances and Prohibited Methods of Doping adopted by the United States Anti-Doping Agency. I also accept sole responsibility for my own conduct and actions while participating in the Event, and the condition and adequacy of my equipment.
4. I hereby Release, Waive and Covenant Not to Sue, and further agree to Indemnify, Defend and Hold Harmless the following parties: THE RICK CENTANNI MEMORIAL FUND AND THE BLUE RIBBON TRUST FUND FOR ROBERT COTTLE , The City of Yorba Linda, the Placentia-Yorba Linda Unified School District the Event Organizers and Promoters, Race Directors, Sponsors, Volunteers, Advertisers, Host Cities, Local Organizing Committees, Host Cities, Host Agencies and Departments, Venues and Property Owners upon which the Event takes place, Law Enforcement Agencies and other Public Entities providing support for the Event, and each of their respective parent, subsidiary and affiliated companies, officers, directors, partners, shareholders, members, agents, employees and volunteers Individually and Collectively, the “Released Parties” or “Event Organizers”, with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss or expense (including court costs and reasonable attorneys fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate to my participation in the Event, including claims for Liability caused in whole or in part by the negligence of the Released Parties. I further agree that if, despite this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liability which any may be incurred as the result of such claim. I hereby warrant that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by signing it (including the rights of the minor, my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns), acknowledge that I have signed this Agreement freely and voluntarily, without any inducement, assurance or guarantee, and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement.
